AND MUTUAL RELEASE
This Marital Settlement Agreement (“Agreement”) is made and entered into on this ___ day of ______, 20__, by and between HUSBAND (“Husband”) and WIFE (“Wife”), collectively “the Parties.” The Parties were lawfully married on ______________, and separated on ______________. Two minor children were born of this marriage. The Parties mutually desire to settle amicably all rights and obligations arising out of the marital relationship, including division of property, debts, and support.
The family residence shall be: Sold & Proceeds Split Equally.
Net proceeds after mortgage payoff and closing costs to be divided equally between the parties.
Financial accounts: the following accounts shall be divided and/or awarded as stated:

The Parties shall assume responsibility for debts as follows:
The Husband shall pay to the Wife spousal support in the amount of $1,200 per month for a period of 36 consecutive months, or until the earlier remarriage of either party or death of either party.
The Parties shall share joint legal custody, with primary residence with Wife. Child support shall be paid by the Husband in the amount of $850 per month, payable on the first day of each month, subject to adjustment by court order.
Visitation: Alternate weekends and every Wednesday evening; holidays alternating per even/odd years.
Each Party waives any right of inheritance from the estate of the other. This Agreement constitutes the entire agreement between the Parties and may be modified only by a written instrument signed by both Parties. If any provision is held invalid, the remaining provisions shall continue in full force and effect. This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles, and shall be binding upon the heirs, executors, administrators, and assigns of the respective Parties.
